Live Case Inc. Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") are an agreement between you and Live Case Inc. ("LiveCase", "we", "us"). They govern your use of Live Case, accessible at https://www.livecase.com, including our websites, applications and services (together, the "Service"). By creating an account, accessing the Service — including through your institution's learning platform — or clicking to accept, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If your access is provided through a school, university, employer or other organization, a separate agreement between us and that organization may apply; where its terms conflict with these Terms, that agreement prevails for your use.

2. The Service

LiveCase is an immersive, case-based learning platform. Authors create interactive cases; hosts and educators run sessions; learners ("players") work through cases, answer questions and converse with AI-powered characters by text or voice. We may add, change or remove features as the Service evolves.

3. Eligibility and accounts

  • You must be at least 13 years old (or older where your local law requires) to use the Service. If you use the Service on behalf of an organization, you confirm you have authority to bind it.
  • You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.
  • Accounts provisioned by your institution may be subject to your institution's own rules and codes of conduct in addition to these Terms.

4. AI features

  • You are interacting with AI. Characters in cases — their text, voice and video — are generated by artificial-intelligence systems, not by humans. AI characters are fictional; any resemblance to real persons is not an assertion of fact.
  • Not all grading is AI. Scores, correct answers and feedback may be set in advance by the case author, applied by fixed scoring rules, generated by AI (for example, for open-ended answers and AI conversations), or reviewed and adjusted by your educator. The cautions below apply where AI is involved.
  • AI output can be wrong. AI-generated content may be inaccurate, incomplete or inappropriate despite our safeguards. It is provided for learning purposes only and is not professional, legal, medical, financial or academic advice. Educators remain responsible for how AI-assisted grades and feedback are used in their courses.
  • Voice mode is optional. Voice conversations stream your microphone (and, in video mode, camera) to our voice-AI provider as described in the Privacy Policy. Use text mode if you prefer.

5. Your content

  • You keep ownership of the content you create or upload — cases, characters, files, answers, messages and other material ("User Content").
  • License to us: you grant Live Case Inc. a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for example, transcoding or generating AI character interactions from case material), display and distribute your User Content solely to operate, provide, secure and support the Service, including making it available to the users, sessions and institutions you or your institution authorize.
  • Authors are responsible for having the rights to the material they include in cases (including embedded media) and, where they publish cases to a catalog or sell access, authorize us to display case titles, descriptions and imagery for that purpose.
  • Learners understand that their session contributions (answers, scores, transcripts) are shared with their session's host, author and institution as part of how the Service works.
  • We may remove or disable content that violates these Terms or the law.

6. Acceptable use

You agree not to:

  • break the law, infringe others' rights, or upload content that is unlawful, defamatory, harassing, hateful or obscene;
  • upload malware, probe or disrupt the Service, or attempt to access data or accounts that are not yours;
  • scrape the Service, or reverse engineer, decompile or copy the Service or its software except where the law permits;
  • misuse AI features, including attempting to extract other users' data from AI systems or generating content that violates these Terms;
  • impersonate any person, misrepresent your affiliation, or use another person's account;
  • resell or commercially exploit the Service or its content except as expressly allowed (for example, authors selling access to their own cases through the platform).

7. Purchases, subscriptions and refunds

  • Prices are shown at checkout and may change; applicable taxes may be added. Payments are processed by Stripe.
  • Access to paid cases or plans starts when we confirm payment. Unless required by law or expressly stated otherwise at purchase, fees are non-refundable once you have accessed the purchased content.
  • If you are a consumer in the EU or UK: by accessing digital content immediately after purchase you request immediate performance and acknowledge that you lose the statutory 14-day right of withdrawal once performance has begun. If something went wrong with your purchase, contact us at [email protected] — we will try to make it right.
  • Institutional pricing, invoicing and payouts to authors are governed by the applicable separate agreement.

8. Intellectual property complaints

We respect intellectual-property rights. If you believe content on the Service infringes your copyright, send a notice with enough detail to identify the material and your rights to [email protected]. We may remove content and, for repeat infringers, terminate accounts.

9. Termination

  • You may stop using the Service at any time and may delete your account from your account settings.
  • We may suspend or terminate your access if you materially breach these Terms, if required by law, or if your institution's agreement with us ends. Where reasonable, we will give you notice.
  • Sections that by their nature should survive termination (including licenses needed to preserve session records for institutions, disclaimers, and limitations of liability) survive.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, Live Case Inc. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that content — including AI-generated content — is accurate, complete or current. Nothing in these Terms limits rights that consumer-protection law grants you that cannot be waived.

11. Limitation of liability

To the fullest extent permitted by law, Live Case Inc. and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising out of or related to the Service, and our total liability for all claims relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim arose or one hundred US dollars (USD 100). Some jurisdictions do not allow certain limitations, so these may not fully apply to you.

12. Indemnity

If you use the Service on behalf of an organization or as an author, you will indemnify Live Case Inc. against third-party claims arising from your User Content or your breach of these Terms, to the extent permitted by law.

13. Changes to the Service and to these Terms

We may revise these Terms from time to time. For material changes we will provide reasonable advance notice on the Service (and, where appropriate, by email) and update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to conflict-of-law rules, and you and Live Case Inc. submit to the exclusive jurisdiction of the state and federal courts located in Delaware — except that if you are a consumer habitually resident in the EU or UK, you keep the benefit of mandatory protections and courts of your country of residence where the law provides them.

15. Miscellaneous

These Terms, together with the Privacy Policy and any applicable institutional agreement, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
